Terms of Service

2. Definitions
"SuperMe" or "Platform": refers to the online service accessible at www.mysuperme.com and via the mobile application, offering therapy, coaching, yoga and wellness services, operated by MyEntourage Sàrl.
"User": refers to any adult natural person who creates an account and accesses the Platform's services.
"Expert" or "Professional": refers to any qualified independent service provider (therapist, coach, yoga teacher) registered on the Platform. Experts are not employees of MyEntourage Sàrl.
"Session": refers to any individual or group session conducted online or in person via the Platform.
"Content": refers to all texts, videos, recordings, programmes and resources available on the Platform.
"ToS": refers to these Terms of Service applicable to Users.
3. Acceptance and scope
Access to the Platform and use of the Services implies full acceptance of these ToS, materialised by checking the box "I accept the Terms of Service" when creating an account.
MyEntourage Sàrl reserves the right to modify these ToS at any time. In the event of a material change, Users will be notified by email at least 30 days before the new conditions take effect. Continued use of the Platform constitutes acceptance. Users who disagree may close their account free of charge before the effective date.
4. Access conditions and registration
4.1 Eligibility
Access to the Platform is restricted to natural persons who are 18 years of age or older, legally capable of contracting, not subject to a judicial obligation to undergo therapy, and in possession of a compatible device and Internet connection.

4.2 Account creation
Users create their account by providing accurate, complete and up-to-date information. They are solely responsible for the confidentiality of their login credentials. Any unauthorised use must be reported immediately to support@mysuperme.com.
5. Description of services
5.1 Nature of the Platform
SuperMe is a matching platform connecting Users with independent Experts. MyEntourage Sàrl acts as a technical intermediary and is not itself a provider of therapy, coaching or yoga services. Experts operate entirely independently.
5.2 Services offered
Individual online therapy sessions with certified therapists;
Individual or group coaching sessions (life coaching, executive coaching, wellness coaching, parenting);
Online yoga classes led by qualified teachers;
Wellness tools, personalised programmes and online resources.
5.3 Service limitations
⚠ SuperMe is not a medical or psychiatric service and does not replace a medical consultation, psychiatric treatment or emergency care. Services must not be used in a crisis situation.
MyEntourage Sàrl does not guarantee the results of sessions. Results vary from one individual to another.
6. Payments and billing
6.1 Pricing
The cost of each session is communicated to the User before any booking confirmation, inclusive of all applicable taxes. MyEntourage Sàrl reserves the right to modify prices with 30 days' notice.
6.2 Accepted payment methods
Credit or debit card;
PayPal;
Apple Pay;
Google Pay;
SEPA bank transfer.
Payments are processed by PCI-DSS certified third-party providers. MyEntourage Sàrl does not store card data.
6.3 Invoicing
A payment receipt is automatically sent by email after each transaction. Users can access their payment history from their personal account area.
7. Right of withdrawal

7.1 Applicable to EU consumers
In accordance with EU Directive 2011/83/EU, any User residing in the European Union has a right of withdrawal of 14 calendar days from the date of subscription or purchase, without needing to give reasons or pay penalties.
7.2 Waiver for immediately executed services
If the User expressly requests that a session begins before the expiry of the 14-day period, they acknowledge waiving their right of withdrawal for the portion of service already performed. This waiver is agreed expressly at the time of booking confirmation.
7.3 Exercising the right of withdrawal
Notify MyEntourage Sàrl before the 14-day deadline by email to support@mysuperme.com. The refund will be processed within 14 days via the original payment method.
ℹ Swiss Users: SuperMe contractually grants an equivalent right of withdrawal to all its Users, although there is no generalised statutory right of withdrawal under Swiss law.
8. Cancellation and rescheduling
8.1 Cancellation by the User
Cancellation at least 24 hours before the session: full refund or account credit.
Cancellation less than 24 hours before: the session may be charged in full.
No-show: the session is charged in full, with no refund.
8.2 Cancellation by the Expert
If an Expert cancels less than 24 hours before the session, the User will be fully refunded or receive an account credit.
8.3 Platform technical issues
If access to a session is impossible due to a Platform technical failure, the User will be fully refunded or their session rescheduled at no cost.
9. Confidentiality and data protection
MyEntourage Sàrl processes personal data in compliance with the GDPR, the Swiss revFADP, and the UK GDPR. Full details are available in the Privacy Policy at www.mysuperme.com/privacy.
9.1 Session confidentiality
Experts are bound by the confidentiality obligations of their profession. Session content is strictly confidential, subject to mandatory reporting exceptions in cases of serious and imminent danger.
9.2 User rights
Right of access (Art. 15 GDPR);
Right to rectification (Art. 16 GDPR);
Right to erasure (Art. 17 GDPR);
Right to data portability (Art. 20 GDPR);
Right to object to processing (Art. 21 GDPR);
Right to withdraw consent at any time.

10. User conduct
By using the Platform, Users undertake to respect Experts and other Users, not to record or distribute session content without prior written consent, not to use the Platform for unlawful purposes, and not to attempt to circumvent security systems.
10.1 Prohibition on direct contact with Experts
Users expressly undertake not to directly contact an Expert met via the Platform outside SuperMe's integrated tools, for the duration of their use and for 12 months following the last session. Any circumvention may result in account suspension and a claim for damages from MyEntourage Sàrl.
10.2 Reporting
Any inappropriate Expert behaviour may be reported to support@mysuperme.com.
11. Intellectual property
All Platform elements are the exclusive property of MyEntourage Sàrl or are subject to licences, protected by the SuperMe trademark (WIPO No. 1867119, IPI Switzerland No. 829678) and applicable intellectual property laws. Any reproduction, modification or distribution without prior written authorisation is prohibited.
12. Liability of MyEntourage Sàrl
12.1 Role as technical intermediary
MyEntourage Sàrl acts exclusively as a technical intermediary and does not provide therapy, coaching or yoga services directly. It does not guarantee the quality or results of Expert services.
12.2 Limitation of liability
MyEntourage Sàrl shall not be liable for indirect, consequential or unforeseeable damages. Total liability for any 12-month period is limited to the total amount paid by the User in the preceding 12 months.
13. Account suspension and termination
13.1 Termination by the User
Users may close their account at any time without notice or fees, from their account settings or by email to support@mysuperme.com. Termination takes effect within 30 days.
13.2 Termination by MyEntourage Sàrl
MyEntourage Sàrl may suspend or terminate an account in cases of ToS breach, abusive or fraudulent conduct, false information, or non-payment. Where the breach is remediable, a prior written warning will be issued.
14. Dispute resolution

14.1 Complaints
Complaints must be addressed first to support@mysuperme.com. MyEntourage Sàrl undertakes to acknowledge receipt within 5 business days and respond within 30 calendar days.
14.2 Amicable resolution
The Parties undertake to seek an amicable resolution before any legal proceedings. An attempt at conciliation must be made at least 30 days before any legal action.
14.3 Competent jurisdiction
Failing amicable resolution, disputes shall be subject to the exclusive jurisdiction of the courts of Lausanne (Vaud), Switzerland.

15. Governing law

These ToS are governed by substantive Swiss law, excluding conflict of law rules and the Vienna Convention on the International Sale of Goods. For EU Users, mandatory consumer protection provisions of their country of residence remain applicable. For UK Users, the Consumer Rights Act 2015 and Consumer Contracts Regulations 2013 apply.
16. Force majeure
MyEntourage Sàrl shall not be liable for failure to perform obligations in cases of force majeure as defined by Swiss law (CO art. 119), including natural disasters, Internet outages, epidemics or unforeseeable governmental decisions.
17. Amendments to the ToS

In the event of a material change to these ToS, Users will be notified by email at least 30 days in advance. Continued use of the Platform constitutes acceptance. Users who disagree may close their account free of charge before the effective date.
